Terms of use for the website · Last updated: 15 July 2026 · The Czech version prevails in case of discrepancy.
IMPORTANT NOTICE: This website is NOT a public offer of investments or securities within the meaning of Act No. 256/2004 Coll., on Capital Market Undertakings. It is intended exclusively for investors meeting the conditions under Section 15(4) of Act No. 240/2013 Coll., on Investment Companies and Investment Funds (the "ZISIF"), for a venture capital person.
1. Introductory provisions
These terms of use (the "terms") govern access to and use of the website available at atavus.cz (the "website").
The operator of the website is Atavus, osoba rizikového kapitálu, s.r.o., with its registered office at Příčná 1892/4, Nové Město, 110 00 Prague 1, Company ID (IČO) 29630681, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, File 449770 (the "operator", "manager", or "ATAVUS").
By accessing the website you express your agreement with these terms. If you do not agree with the terms, please do not use the website.
2. Manager status and proposed structure
Atavus, osoba rizikového kapitálu, s.r.o. has registered in the Commercial Register the business activity of "asset management comparable to the management of an investment fund under Section 15 of Act No. 240/2013 Coll., on Investment Companies and Investment Funds." On 4 July 2026 the company applied for registration on the list maintained by the CNB. It will not commence activity under Section 15 ZISIF or accept an investment before registration is verified. After registration, the proposed private program is intended to manage assets focused on show jumping sport horses within the applicable ZISIF threshold.
For the physical care of the horses in the program's portfolio, the company is further authorised under a free trade licence, in the field of "Animal breeding and training (except livestock production)."
Any registration is evidentiary. The company does not hold a licence to operate as an investment company and its activity under Section 15 ZISIF is not subject to supervision by the Czech National Bank. This does not affect its specific obligations under ZISIF, PRIIPs, SFDR, AML, and other applicable laws.
Trade licence: Production, trade, and services not listed in Annexes 1 to 3 of the Trade Licensing Act (free trade licence under Act No. 455/1991 Coll.)
Managed assets limit: up to EUR 100 million (Section 15(2)(a) ZISIF)
The information presented on this website is provided for informational purposes only and does not constitute a securities prospectus, key information for investors (KID/PRIIPs), or any other regulatory document within the meaning of applicable regulations. Binding information for investors is contained exclusively in the investment terms and the information memorandum provided to the investor before the conclusion of a contract under Section 15(4) ZISIF.
3. Who can invest (conditions under Section 15(4) ZISIF)
Atavus, osoba rizikového kapitálu, s.r.o. has applied for registration on the list of persons under Section 15 ZISIF maintained by the Czech National Bank. It does not accept investments before registration is verified. Once registered, a specific offer may be made available only to a named and recorded person through one of the following routes:
- Route A: the investor actually invests at least EUR 125,000, or the equivalent in another currency, through the company; a promise or unfunded commitment is insufficient.
- Route B: a named person below the amount threshold is recorded before being approached within the conservatively managed statutory cap of 20 persons, and acceptance is subject to prior legal and PRIIPs clearance.
Under either route, each investor must receive written advance disclosure of risks, the absence of a guarantee, fees, horizon, strategy, and the absence of CNB supervision. The company conducts an individual suitability assessment, AML/KYC, and, for any retail investor, an assessment of applicable PRIIPs obligations.
Submitting the contact form is not a specific offer, creates no right to acceptance, and does not bind the person submitting it.
4. Access and use restrictions
The information contained on this website:
- does not constitute a public offer, and specific terms are provided only to a named and recorded person after route classification,
- is not intended for natural or legal persons who are "US Persons" within the meaning of US law (Regulation S, the Securities Act of 1933), and their access to this website or any investment may be subject to prohibitions or restrictions under US law,
- must not be distributed or further disseminated in jurisdictions where such distribution would be contrary to local law.
Accessing the website does not confirm investor status, and the company does not treat you as an investor. You represent only that you are not a "US Person" and are accessing general information from a jurisdiction where such access is lawful.
5. Investment risks
A contractual participation in a private asset management program under Section 15 ZISIF carries substantial investment risk. Key risks include:
- Risk of loss of principal: the value of the investment may fall below the amount of the initial investment; the return of capital is not guaranteed.
- Illiquidity risk: a contractual participation in the ATAVUS program is difficult to transfer to third parties; entry and exit take place exclusively by contractual means, and no regular payouts or redemptions are offered.
- Concentration risk: the program portfolio is concentrated in a specific asset class (the equestrian industry, show jumping sport horses), whose value is sensitive to factors specific to that sector.
- Operational and biological risks: risks associated with the management, breeding, and sale of live animals, veterinary events (injury, illness, death), training, and international logistics.
- Risk of limited regulatory protection: a sub-threshold manager is not subject to full CNB supervision; investor protection is lower than for funds managed by a licensed investment company under Section 479 ZISIF.
- Regulatory risks: changes to ZISIF, AIFMD, tax law, or rules on trading in live animals (welfare, CITES, EU veterinary regulations) may have a negative impact on portfolio value and program results.
- Currency risk: part of the assets may be denominated in foreign currencies (EUR, USD).
Before making any investment, we recommend consulting an independent investment adviser licensed by the CNB and carefully reviewing the investment terms and the information memorandum provided to the investor under Section 15(4) ZISIF.
6. Past performance
Any historical performance or return data referenced in ATAVUS materials is illustrative only. Past performance is not a guarantee or indicator of future returns. The value of the investment and the returns from it can fall as well as rise.
7. Intellectual property
All content on this website · including text, graphics, the ATAVUS logo and trademark, the heraldic symbol, data visualisations, and code · is protected by copyright under Act No. 121/2000 Coll. (the Copyright Act) and international conventions on the protection of copyright.
Without the prior written consent of the operator, it is not permitted to copy, distribute, modify, or commercially exploit the content of the website.
8. Limitation of the operator's liability
The operator makes reasonable efforts to keep the information on the website current and accurate, however:
- it does not warrant the completeness, accuracy, or currency of the information on the website,
- it is not liable for any direct or indirect damage arising in connection with the use of the website or reliance on the information contained in it,
- it is not liable for the availability of the website or for damage caused by technical outages,
- it bears no responsibility for the content of third-party websites to which the website links.

9. Changes to the terms
The operator reserves the right to change these terms at any time. The current version of the terms is always available on this page, with the date of the last update indicated. Continued use of the website after changes are published is deemed acceptance of those changes.
10. Governing law and jurisdiction
These terms are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll. (the Civil Code), Act No. 240/2013 Coll., and Act No. 256/2004 Coll.
Any disputes arising from or in connection with these terms will be resolved by the courts of the Czech Republic with subject-matter and territorial jurisdiction.
11. Effectiveness
These terms take effect on the date of their publication on the website, i.e. 25 May 2026.
